1. Acceptance of Terms

By accessing or using iHOST (the "Service"), operated by Interchained ("we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and Interchained. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.

2. Service Description

iHOST provides unmanaged Virtual Private Server (VPS) hosting services powered by cryptocurrency payments. Cryptocurrency projects are welcome, blockchain and all crypto tokens or coins are welcome to build DApps and host blockchains. We act solely as an intermediary platform connecting users with underlying infrastructure providers, including but not limited to DigitalOcean.

UNMANAGED SERVICE NOTICE: All VPS instances provided through iHOST are completely unmanaged. You are solely responsible for all configuration, security, software installation, maintenance, and content hosted on your VPS.

3. User Responsibilities and Acceptable Use

3.1 Content Responsibility

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT, DATA, APPLICATIONS, AND ACTIVITIES CONDUCTED ON YOUR VPS. This includes, but is not limited to:

  • All files, data, and content stored on your VPS
  • All software, scripts, and applications installed or executed
  • All network traffic, both inbound and outbound
  • All user accounts, passwords, and access controls
  • All backups and data recovery procedures

3.2 Legal Compliance

YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR USE OF THE SERVICE COMPLIES WITH ALL APPLICABLE LAWS AND REGULATIONS IN YOUR JURISDICTION AND ANY JURISDICTION WHERE YOUR CONTENT MAY BE ACCESSED.

This includes, without limitation:

  • Local, state, federal, and international laws
  • Data protection and privacy regulations (GDPR, CCPA, etc.)
  • Intellectual property laws and licensing requirements
  • Export control and sanctions regulations
  • Content distribution and age verification laws
  • Anti-spam and electronic communication laws

3.3 Prohibited Activities

You agree NOT to use the Service for any unlawful purpose or any purpose prohibited under these Terms. Prohibited activities include, but are not limited to:

  • Hosting, distributing, or facilitating illegal content
  • Conducting denial-of-service (DoS/DDoS) attacks
  • Spamming, phishing, or fraudulent activities
  • Hosting malware, viruses, or malicious code
  • Copyright infringement or intellectual property violations
  • Unauthorized access to computer systems or networks
  • Child exploitation material or any illegal pornographic content
  • Terrorist content or activities that promote violence

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

4.1 No Liability for User Content

WE EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY CONTENT, DATA, OR ACTIVITIES CONDUCTED ON OR THROUGH YOUR VPS. WE HAVE NO CONTROL OVER, DO NOT MONITOR, AND ARE NOT RESPONSIBLE FOR:

  • Content stored, transmitted, or displayed on your VPS
  • Software or applications you install or execute
  • Actions taken by you or third parties using your VPS
  • Security vulnerabilities in your configurations or software
  • Data breaches resulting from inadequate security measures

4.2 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service operation
  • Specific uptime percentages or service level agreements
  • Data integrity, backups, or disaster recovery
  • Performance, speed, or resource availability
  • Compatibility with your specific use case or requirements

4.3 Maximum Liability Cap

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (1) MONTHS PRECEDING THE CLAIM.

4.4 Exclusion of Consequential Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Business interruption or downtime
  • Damage to reputation or goodwill
  • Third-party claims or legal fees

5. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS INTERCHAINED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND PARTNERS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, EXPENSES, OR FEES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM OR RELATING TO:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any laws, regulations, or third-party rights
  • Content hosted, stored, or transmitted through your VPS
  • Activities conducted by you or third parties using your VPS
  • Claims by third parties related to your use of the Service
  • Any negligence or willful misconduct on your part

This indemnification obligation shall survive termination of these Terms and your use of the Service.

6. Payment Terms

6.1 Cryptocurrency Payments

All payments must be made in cryptocurrency through our payment processor. By making a payment, you acknowledge that:

  • Cryptocurrency transactions are irreversible and non-refundable
  • You are responsible for transaction fees and network costs
  • Exchange rate fluctuations are your sole responsibility
  • We are not responsible for failed or delayed blockchain transactions

6.2 Billing and Auto-Renewal

Services are billed in advance based on your selected billing cycle:

  • Hourly Billing: Charged daily (hourly rate × 24 hours) from your account balance
  • Monthly Billing: Charged upfront for 30 days of service
  • Automatic billing occurs from your prepaid balance
  • Services are suspended when balance is insufficient
  • Servers are permanently deleted 24 hours after suspension

6.3 No Refund Policy

ALL SALES ARE FINAL. WE DO NOT PROVIDE REFUNDS, CREDITS, OR PRORATED BILLING FOR:

  • Unused service time or prepaid balances
  • Account terminations or service suspensions
  • Dissatisfaction with service performance or features
  • Changes in your business needs or requirements
  • Technical issues or service interruptions

7. Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Implementing and maintaining two-factor authentication (2FA)
  • Securing your VPS instances and preventing unauthorized access
  • Notifying us immediately of any unauthorized use or security breaches

8. Service Suspension and Termination

8.1 Right to Suspend

We reserve the right to immediately suspend or terminate your access to the Service, without notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected illegal activity or abuse
  • Receipt of legal process or law enforcement requests
  • Abuse complaints from third parties
  • Excessive resource usage affecting other users
  • Insufficient account balance

8.2 Data Deletion

UPON TERMINATION OR SUSPENSION, ALL DATA ON YOUR VPS MAY BE PERMANENTLY DELETED WITHOUT NOTICE. WE ARE NOT RESPONSIBLE FOR BACKING UP YOUR DATA OR PROVIDING DATA RECOVERY SERVICES.

9. Intellectual Property

The Service, including all software, documentation, and branding, is owned by Interchained and protected by intellectual property laws. You may not:

  • Copy, modify, or reverse engineer any part of the Service
  • Remove or alter any proprietary notices or labels
  • Use our trademarks or branding without written permission
  • Resell or redistribute the Service without authorization

10. Third-Party Services

We utilize third-party infrastructure providers (e.g., DigitalOcean) to deliver the Service. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for:

  • Actions, errors, or omissions of third-party providers
  • Changes to third-party services or pricing
  • Third-party service interruptions or data loss
  • Third-party terms of service violations

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability of the Service
  • Security or freedom from viruses or harmful code

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable to Interchained's place of operation, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively through binding arbitration in accordance with commercial arbitration rules, except that either party may seek injunctive relief in court for violations of intellectual property rights.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be effective upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Interchained regarding the Service and supersede all prior agreements and understandings.
